A Centre County judge has dismissed a homicide by vehicle while DUI charge against a Vermont truck driver accused of causing a crash that killed a Hollidaysburg woman.

But Judge David Grine will allow black box evidence that show’s the rig was speeding to be presented in the trial of Peter Carrara. 57-year-old Bonnie Weaver of Hollidaysburg was killed in the May 2007 crash along State Route 64 in Walker Township.

Police say Carrara was under the influence of methamphetamine when his tractor trailer crashed into and then rolled over Weaver’s car. Carrara’s defense attorneys say a search warrant was needed before police could take the black box from the truck. But Judge Grine disagreed. The ruling will also allow prosecutors to enter into evidence all the items found inside Carrara’s truck cab. His defense attorneys plan to appeal.

Carrara is still facing homicide by vehicle and several other related charges.
